Terms and Conditions

It is important to read these Terms and Conditions before accessing the training material on this module.

The Licensor owns and operates this E-Learning module and by proceeding to access this material, you (Licensee) are purchasing a License to Access the information within the module. This is quite distinct from owning the material or information therein.

By proceeding with the purchase to access this E-Learning module the Licensee agrees to these Terms and Conditions.

1. Description and Nature of the Content

E-Learning (on-line training) Licensee can purchase a training activity on Drug and Alcohol Policy and Procedures as applied in a typical New Zealand or Australian workplace and complete the course on-line. The content of the module is general educational material and is not a substitute for situation-specific legal advice. Whilst the Licensor takes all reasonable steps to ensure that the content is accurate and up to date, the content is provided without any warranties of any kind, including any implied warranties. In addition, to the maximum extent permitted by law, the Licensor disclaims any liability to the Licensee in relation to the use of the content within the module.

2. Using the Module

The Licensor grants to the Licensee a non-exclusive, non-transferrable, revocable License to Use the Module in accordance with the instruction on the Module platform and these Terms and Conditions. The Module can be completed in one sitting in, say, 30 minutes, if one does not linger. The Licensee will have the capability of returning to the Module multiple times for up to 3 days, without further cost. If you successfully complete the Module within the 3 day deadline, you will be issued with a Certificate of Completion. If you do not successfully complete the Module by the deadline, your access to the Module will cease and a further entry payment would be required if you wished to re-enter.

3. Certificate of Completion

The purpose of the Certificate of Completion issued on the Module is to certify that you have successfully accessed and completed the information and exercises within the Module. The Certificate does not certify that you are qualified or necessarily equipped to perform any task or carry out any activity.

4. Module for Personal Use Only

Access to this Module is restricted to the person who is the Licensee. The Licensee undertakes not to share access to this Module with any other person, including by using this module in a group setting, classroom type setting, or similar. The Licensee will similarly not allow any other person to access the Module during the currency of the Licensees License to Use.

5. Intellectual Property Rights

The Licensee acknowledges that all intellectual property rights in this Module, anywhere in the world, belong to the Licensor. The rights in the E-Learning Module are licensed (not sold) to the Licensee and the Licensee has no rights in, or to, the training materials or Licensors ‘know how’, other than the rights to use them in accordance with the Terms and Conditions of this License. Additionally all of the content of the Module (including text, videos, images, trademarks, layout and ‘look-and-feel’(Content) is subject to copyright and other proprietary rights belonging to the Licensor. The Licensee agrees not to copy, reproduce, photograph, share, post, modify, transmit, distribute, store (physically or electronically) or in any other way, exploit any Content other than as expressly set out in the instructions within the Module or these Terms and Conditions, or permit any other person to do so.

6. General

These Terms and Conditions are governed by the laws of New Zealand without reference to principles of conflict of laws. The Licensee agrees to be bound by New Zealand law and to submit to the exclusive jurisdiction of the Courts of New Zealand in connection with the interpretation or application of these Terms and Conditions.

7. Privacy Statement

Any and all information of the Licensee collected by the Licensor, will be used for the purpose of communication via the Module or pertaining to the course material. This information will be held tightly by the Licensor and will not, in any circumstances, be made available, to any third party without the knowledge and express permission of the Licensee.

Payment for access to the Module is made through a secure third party, bank initiated, payment site and accordingly the Licensor does not receive any payment related information, such as detail of the transactionary bank card or account used.
